The administration cannot enforce updates to Title IX rule while the case brought by the states is litigated.
The U.S. Supreme Court rejected the request from President Biden’s administration to vacate injunctions against their changes to Title IX. The block against implementing the updates to the rule will remain in place until the Sixth Circuit U.S. Court of Appeals hears the case in October.
The majority decision stated, “On this limited record and in its emergency applications, the Government has not provided this Court a sufficient basis to disturb the lower courts interim conclusions that the three provisions found likely to be unlawful are intertwined with and affect other provisions of the rule.”
The concepts and promotion of transgender equality, including the access of males to female spaces such as bathrooms and locker rooms, as well as transgender surgeries and therapies for minors, are important issues at stake in this election cycle.
